It was not clear how this amendment affects, so I did some reading myself and found how it quietly does it. And adds a little incentive i.e. the total number may not exceed 650,000. In other words, alloting 200,000 for dependants(650,000 total - 450,000 primary)
I get a feeling that this might pass if it is presented on the floor smartly to kindle some number/cost sentiment.
Notwithstanding any other provisions of this act the language in Title V Sec. 501 under the heading ``

Don't sweat it. I too overlooked this field during my last e-filing in 2008. The date of last arrival field is easy to miss, since it is embedded right under a set of "previous EAD" fields, some of which you would likely leave blank if you don't have too many previous EADs. I simply included this data item on a separate piece of paper with my supporting documentation. I didn't face any delays in my EAD approval...it was approved in a few weeks.
I don't think this is any cause for concern.
I guess USCIS IT department does not have the budget to hire a usability expert to review their e-filing forms. Some of those forms look like "hello world" projects. :)

This time the online process seemed little different, they were asking for few info at a time and we got to click the continue button...I was just doing fine and was waiting that at some point it would show the complete application for me to review, but I got to the last page and said something like "Submit" or "Finish" and I did ...everything was ok got the confirmation....OOPS, left the date of last arrival blank! Had put the Port of arrival correct, but left the date blank!
How is this going to affect my EAD, anyone had similar experience ? In the confirmation, it had instructions that I will get notice for finger printing appt and other documents to be sent.
Really pissed off! Very bad mood today!
Can't the system check for missing information! Even mom & pop online services check for all information before accepting! Anyways, no excuse for me , I should have been careful!
Anyone who got a RFE for missing to information and how long it took after responding to the RFE, Please share your experiences!

Beware of contractual agreements between your company and the end client. Normally they will have contrac that you will no join the vendor or client directly after the contract is terminated. You will be in legal problems. This is nothing to do with your GC.
I recommend, since you go GC find a job else where once you are fired by your company.

I am in the same boat.
I applied I-140 in premium processing(Labor applied Apr 2004, Approved Jan 2007). Got RFE to show 5 yrs of exp. My Lawyer replied to RFE on 26th July and USCIS received the documents on 30th of July 2007.
The problem is that USCIS site is showing that they will take upto 60 days to reply. Though I have applied in Premium processing but I guess they answer queries in normal time.
There is a 50-50 chance of getting my RFE cleared. Please suggest:
1. Can I file I-485 before 17th Aug ?
2. If I can, do I have to pay old Fees ?
3. Can I file without medical ?
Please guide ?

Good that we see more proof of Apps received on Jun 29 getting receipted.
I am sure Aug 1st , NSC will become compaint to their receipting release and start receipting everyone who had applied till July 10th.
I read somewhere that many or most or some 485 cases will be or have been transferred to TSC from NSC. and according to the july 20 processing time updates, TSC will be complaint by 10/26. doesnt it sound too good that NSC will be compliant so soon ? Again, i am an eternal pessimist....

Looks like I can not file the new one in EB2 as long as I'm with the current employer as the masters degree completed after joining the current employer. I would have to look for a different employer in case I need to file a new one again.

My H1 is approved on Oct 23, 2006. I was on F1. Before my OPT grace period expired on July 20, 2006, I enrolled in a school with new I-20 on July 5th, 2006. I have been taking one class every month for last three months to maintain full time status. If I stop taking classes now, would it be a some kind of problem when I go for visa stamping?

And it may well depend upon the demand for H1b visas this year. If there is a huge demand for H1b visas like last year, there is a good chance congress may recapture lost H1b visas. Then EB visas may also be recaptured along with H1b visas.
But I'm not sure about the demand for H1B this year , as H4 to H1 conversion will be down this year due to (most of) H4 visa holders getting EAD. Another issue is if OPT is increased to 24 months, then F1 to H1 will also fall drastically.
Fear of recession may also reduce new H1B visa demand.

Hi,
I had filed for my wife's and my I-485 in July and have since received our EAD's and AP's (I believe in Sept). However, we've still not received our Fingerprinting notice. I had opened a Service Request with USCIS and they responded that its possible that they are probably busy and I should be getting a notice soon. But I just want to check if there are anybody else out there who filed in July and are still waiting for their FP notices.
Please note that I live in Dallas,TX and my case is with TSC.

I lost my job in December but was lucky enough to get back on a project within two weeks. What i find about this post is that it is a strange way of trying to get attention, and attention for what, do you or have you an idea or a roadmap to address the issue ?

Going for some march or peaceful rally that does nothing or very little
come on wake up and start suggesting ways of addressing this and we will be more than willing to participate
Lets talk of productivity not activity where people just send emails or calls etc etc that leads to no where, what we want is a good solid recognition of the fact that the world is a golbal village and productive resources should have a easier path to stay anywhere in the world
By the way without mincing words and with no malice to you...this heading of yours is really an incorrect way of drawing attention cause i know a lot of my friends who have been laid off now for more than two to three months and have been in the US, more than i have i.e. over 8 to 10 years and are still waiting for a GC and have nowhere to go and beleive me are in a very bad shape, emotionally and financially....
So in short either Lead the way with good suggetions/options rather than gathering people and money that leads to nothing and nowhere and only takes 2 leaps forward and 4 leaps backward (in terms of immigration reforms)

But in case of switching from H1b to EAD (while working for H1b/GC sponsoring employer), there is no termination, changes in the employee�s eligibility or change in job duties. So no requirement to cancel H1b.

Switching from H-1B to EAD comes under change in employee's eligibility. That's the reason new I-9 is filed (to reflect change in employee's employment eligibility).
